rock burger

If a restaurant serves you a rock[1] between two very hard pieces of rectangular bread can they call it a Hamburger?

According to me a Hamburger is

a. Round
b. Contains ‘n relatively fresh and soft bun which is cut in half horizontally.
c. Contains a flat beef patty which presents the teeth of the “burger eater” with about the same resistance as a ripe peach.

[1] A cricket ball shaped substance vaguely resembling the taste of meat and the texture of cardboard.
